Annually

Inspect the exterior of your home. Is any paint chipping? Is any siding damaged from winter? Are there any holes in your brick? Take a close look all around your house, and make any repairs as needed. Also be sure to check the foundation for any cracks.

  • Get your air conditioning system ready for summer; consider having it serviced.
  • Repair/replace damaged window screens.
  • Inspect roofing for damage, leaks, etc.Repair as needed; you may need a professional.
  • Take care of any insect problems you may have: Ants, spiders, moths, etc. are all common, and fairly easy to take care of. Keep cobwebs clear, have ant poison handy, make sure all doors are tightly closed, etc.
  • Tighten any handles, knobs, racks, etc.Go through the house and inspect anything that could have a loose screw.
  • Check all locks and deadbolts on your doors and windows.If anything doesn’t work right, replace.

Family arrangement is binding on The Members

Key terms of a family settlement.

Each time there is a crisis in a family, there is talk of a settlement. However, not many know the ingredients of a family settlement. Technically, a family arrangement is an agreement between members of the same family, intended to be general and reasonable for the benefit of the family. It is intended to clear the air over doubtful or disputed rights and preserve the family property—the idea here is to avoid litigation by saving its collective honour.

The agreement in such a case may be either express or implied. An implied family arrangement can be deduced from a lengthy course of dealing. However, the terms are spelt out by way of an agreement, in the form of a deed of ‘family arrangement’. To put the binding into effect and the essentials of a family settlement in a concrete form, the matter may be reduced to specific terms.

The family settlement must be bona fide, in order to resolve family disputes and rival claims, by a fair and equitable division or allotment of properties between the various members of the family. It must be voluntary and not ‘induced by fraud, coercion or undue influence’.

A family arrangement may be even oral in which case, no registration is necessary. Members, who may be parties to the family arrangement, must have some antecedent title, claim or intros-even a possible claim in the property, which is acknowledged by the parties to the settlement.

Additionally, if one of the parties to the settlement has no title but under the arrangement, the other party relinquishes all its claims or title in favour of such a person and acknowledges him to be the sole owner, the antecedent title must be assumed and the family arrangement will be upheld.

Despite a bona fide dispute present or possible, which may not involve legal claims, if settled by a bona fide family arrangement, which is fair and equitable, the family arrangement is final and binding on the parties to the settlement.

Registration would be necessary, only if the terms of the family arrangement are reduced to writing. Here, a distinction must be drawn between a document containing the terms and recitals of the family arrangement made under the document and a mere memorandum prepared after the family arrangement has already been made.

In such a case, the memorandum does not create or extinguish any rights in the properties and therefore does not fall within the ambit of ‘mischief’ of Section 17 (1) (b) of the Registration Act, and is therefore not compulsorily eligible for registration.

Rising defaults by short-term realty investors add to developers’ woes

Short-term real estate investors, a source of quick funds for housing projects, are increasingly defaulting on payment to developers, as economic slowdown and rising cost of living keeps regular home-buyers on the fringes, narrowing exit routes for speculators.

A large number of such investors— who generally buy multiple properties and sell them in six to eight months for quick gains—are approaching developers for refunds, and in some cases even taking them to court, according to some real estate consultants.

“The number of defaults by short term investors has gone up in recent months,” said Navin Raheja, president of National Real Estate Developers’ Council.

India’s property market has slowed over the last few quarters. The slump is more pronounced in its housing segment, where developers are offering discounts to push sales. In the resale market, home-buyers are ready to wait it out. This has not just raised inventory and pinned down prices, but also shrunk the pool of buyers that short term investors target.

“A developer’s cash flow goes for a toss when investors don’t pay up,” said Samarjit Singh, managing director of India Homes, a property broking firm. “Cancelling a booking is the worst option for a developer.”

According to property consultants, short-term investors have cornered 50%-60% of newly built homes on the Dwarka-Manesar Expressway in Gurgaon and about a third of homes coming up in Noida-Greater Noida Expressway. The equation would be similar for the different suburbs of Mumbai, they said.

While some speculators managed to exit these properties before the slowdown set in, a large number of them are still stuck for want of buyers. Many over-leveraged investors who had picked up properties in the last one year are now willing to offload apartments at handsome discounts, sometimes even going up to 30%.

While the discounts are a big attraction, the sentiment in the property market because of the higher inflation, jobs cuts, increasing interest rates and an environment of massive uncertainty all around is pushing end-users to stay away from the real estate market.

Real estate speculators generally pay 20%-30% of an apartment’s value over about six months. When the housing project developer increases prices, these short-term investors sell their apartments to either other investors or end-users at a profit.

“These were the investors who would bring in the much needed liquidity for the developer at the beginning of a project,” said Santhosh Kumar, chief executive officer, operations, at Jones Lang LaSalle India.

According to a Noida-based broker who did not wish to be named, developers generally use such investors to increase prices. “Many developers would offer special rates to them for coming in early, sometimes even before all approvals for a project are in place. The investor was happy because he entered the project at a much lower price than a regular buyer and exited with a good profit,” the broker said.

In view of the situation, some property developers are keeping short-term investors out of their newly launched projects. “They are weeding out such investors by running personal wealth checks on potential investor and asking them for their bank statements before selling homes,” said Abhay Khemka of Khemka Investments and Properties in Gurgaon. “They are also asking brokers to do tougher due diligence before bringing in investors.”

Wooing customers with Branded Homes

Realty companies are going all out to woo customers by offering them branded and special homes.

Even though there is gloom over the economy, realty players are coming up with new and innovative products for their discerning buyers.

You can call them as branded or designer homes. Realty major Supertech, in association with Disney India, is creating the magic of Disney at their proposed residential project, Fable Castle, part of an integrated township, Golf Country, located on Yamuna Expressway, Greater Noida.

R K Arora, CMD of Supertech Limited, says: “Disney characters and stories have inspired every generation and this will give an opportunity to all those who want to have Disney magic in their homes.”

CHD Developers, too, is in the fray of building super luxury and branded homes and is coming up with Spanish Meadows-duplex villas inspired by Spanish architecture-in Karnal. The USP of the villas is that they are ‘expandable’ and have been conceptualised keeping in mind the spiralling aspirational living of the rich, urban customers.

“The lavish villas allow residents to expand their units in accordance with their aspirational lifestyles, ” Gaurav Mittal, MD of CHD Developers, says.

Devinder Gupta of Century 21 DGS says: “These super luxury projects have many takers even during this period of lull in the market. Rich and famous Indians as well as NRIs buy branded homes. If such products had no buyers, realty players would not have made them in the first place.”

Realty companies usually instruct architects to give something unique in their designs in order to attract possible buyers; currently, kitchens are getting a lot of attention from them.

Of course, the kitchen is a space that needs careful and proper planning. Care must be taken in placing the kitchen appliances correctly and the height of the kitchen counter must be calculated accurately.

Nuzhat Alim, director of ILD Developers, says: “It is the endeavour in all our projects to make kitchens the clincher. Usually, as the lady of the house has the final say in finalizing a purchase, we put extra effort to impress them. I feel the flooring in any kitchen should be 1 cm lower than the other floors in the house, and, ideally, paved with marble tiles, ceramic tiles, or terrazzo, which are resistant to chemicals. The kitchen should have a minimum height of 2.75 metres from the surface of the floor to the lowest point in the ceiling. The counter top or the kitchen platform should be placed at a height of 30-36 inches.”

Washrooms, too, are getting a lot attention from realty companies. “If you cannot give a good washroom, it is not possible to sell your product. It is very important for us to be abreast of the latest trends in design and fancy fixtures that go into the modern washrooms and toilets, as customers are very finicky about them. Should it be spacious or cozy? What sort of layout will be best? You must know all these to impress the customers-and, yes, branded fixtures always draw sighs of appreciation,” Sanjay Khanna, director of Kailash Nath Projects, says.

“For people going for a house hunt, it will further their interest enormously if they check out photos of bathrooms from the internet, or one of those innumerable fashion or decor magazines that detail the latest trends-they can then demand these in their new homes, and get them too. Photos and images of other bathrooms can help one visualize the style and character of their new bathroom,” Nikhil Jain, CEO of Ramprastha Developers, says.

“A good bathroom design, like for any other room, benefits from natural light. Getting natural light into your bathroom while maintaining privacy from the neighbours requires good planning; many people spend a lot of their time there. Thus, we have to make it very good with all possible luxuries fitted in it,” Ajay Agarwal, director of Avalon Developers, says.

No wonder that realty companies are putting in such effort to make their products branded and attractive.
